Hamburg/Wien - Ein neues Gesetz sorgt in Indien für heftige Debatten. Für Jugendliche unter 18 Jahren ist Sex ab jetzt verboten, berichtet "Spiegel Online" am Freitag. Wer dies missachte, mache sich der Vergewaltigung strafbar. Der Gesetzgeber sieht darin einen Schutz von Kindern, KritikerInnen befürchten eine Kriminalisierung von Teenagern.

Nach neuester Gesetzgebung macht sich etwa ein unter 18-Jähriger, der mit einer Gleichaltrigen schläft, der Vergewaltigung schuldig und ist mit mindestens sieben Jahren Haft zu bestrafen. Das vom indischen Parlament beschlossene und von der Staatspräsidentin abgesegnete Gesetz zum Schutz von Kindern vor sexuellen Straftaten sieht vor, dass Geschlechtsverkehr nur über 18-Jährigen erlaubt ist. Ob unter Jugendlichen oder zwischen einem Jugendlichen und einem Erwachsenen - selbst einvernehmlicher Sex ist fortan verboten.

Damit hebt Indien das Alter, ab dem Sex erlaubt ist, um zwei Jahre an. Vor einem Jahr hatte Krishna Tirath, Ministerin für Frauen und Kinder, noch betont, ein erster Entwurf sehe vor, das Alter bei 16 Jahren zu belassen. "Die neue Regelung stimmt mit der UNO-Konvention zum Schutz von Kinderrechten überein", rechtfertigte ein Ministeriumsmitarbeiter, der namentlich nicht genannt werden wollte, die Änderung.

Anhebung des Alters sorgt für Kritik

In Indien werden noch immer häufig Kinder und Jugendliche verheiratet. Gleichzeitig nehmen Teenagerschwangerschaften zu. Die Behörden registrieren zudem eine Zunahme von Kinderprostitution und Vergewaltigung von Minderjährigen. "Es ist an der Zeit, dass wir etwas dagegen unternehmen", sagt der Beamte aus dem Frauen- und Kinderministerium.

Dagegen gibt es kaum Einwände - und dennoch wird das Gesetz in den Fernsehsendungen und Zeitungen in Indien heftig debattiert. Für Kritik sorgt die Anhebung des Alters, ab dem Sex erlaubt ist. Begriffe wie "rückschrittlich", "unzeitgemäß", "weltfremd" und "verklemmt" machen die Runde.

Die Altersanhebung öffne "die Schleusen für Strafverfolgung von Burschen auf der Basis von Beschwerden von Eltern eines Mädchens, unabhängig davon, ob das Mädchen zugestimmt hatte", kritisierte Richter Virender Bhat die neue Regelung. Er empfahl der Regierung, das Gesetz zu überprüfen. (APA, 1.6.2012)

'Voluntary sex work is legal'

Indien hat in einer Strafrechtsreform einen wichtigen Schritt in Richtung Entkriminalisierung der Sexarbeit getan.

Sex workers and women's rights activists have welcomed the government's move to differentiate 'prostitution' from exploitation in the amended Section 370 of the Indian Penal Code.
By inserting a new definition of exploitation, the Criminal Law Amendment Bill 2013 passed by Lok Sabha clarifies a position that till date conflated consensual adult sex work and sex trafficking [...].
"This formulation clarifies the government's stand of removing adults voluntarily involved in sex work from the ambit of criminalisation," said Meena Seshu, from the National Network of Sex Workers (NNSW). "This has given a new lease of life to people who are in the sex trade of their own volition, and enables them to seek legal protection if they face violence while working." [...]

Indien: Goa verbietet Playboy-Strandclub

Keine Bunnys für Goa: Der indische Bundesstaat hat einen Playboy-Club verboten. Zuvor hatte es heftige Proteste gegen das Projekt gegeben - manche Anwohner fürchteten, dass dadurch Prostitution gefördert würde.


Es wäre der erste Playboy-Club im konservativen Indien gewesen: An einem Strand in Goa sollte eine Bar entstehen, in der junge Frauen in Bunny-Kostümen die Getränke servieren. Nun wurde der Antrag jedoch abgelehnt. Offizielle Begründung: Die Bauauflagen seien nicht erfüllt worden.

Im November hatte die Firma PB Lifestyle, ein indischer Franchisenehmer der Marke Playboy, angekündigt, in den nächsten zehn Jahren 120 Clubs, Hotels, Cafés und Shops zu eröffnen. Nun gab es gleich einen Rückschlag in Goa, wo der Plan heftige Kontroversen ausgelöst hatte.
"Es gab Bedenken, dass ein solcher Club anstößiges Benehmen fördern würde", sagte Dilip Parulekar, der Tourismusminister von Goa. "Wir beobachten schon jetzt, dass sich Prostitution in der Küstenregion stark ausbreitet.

PB Lifestyle war zunächst nicht für ein Statement zu erreichen. Die Firma hatte angekündigt, keine nackten Frauen dort zu präsentieren, auch das Playboy-typische Bunny-Kostüm wurde für Indien extra entschärft. Die typischen Hasenohren, die Fliege und der Puschelschwanz bleiben allerdings erhalten. Der "Playboy" ist in Indien verboten, ebenso wie viele andere Erotikmagazine aus dem Ausland.

In a bid to address social evils such as trafficking and violence against sex workers, All India Network of Sex Workers (AINSW) plans to set up welfare boards across the country for protection of their rights.

AINSW, an umbrella network of NGOs working for sex workers, has decided to constitute these boards which will comprise sex workers, social activists, doctors, legal experts and political leaders as members.

Bharati Dey [Ex-Sexworker und Durbar Vorstandsmitglied], representing Kolkata-based NGO Durbar Mahila Samannya Committee which is part of AINSW, told PTI [Press Trust of India] that "such a welfare board is essential in all the states to have a uniform system to look into the issue of trafficking and violence".

Most cases of violence and trafficking happens without the knowledge of the police or the local authorities and therefore, needs to be addressed from people within the community, she added.

According to activist Smarjit Jana [ehemals Arzt im Gesundheitsamt und Gründer von Durbar, s.o.], the state police forces in the country have anti-trafficking cells which needs assistance to identify the issues of violence and trafficking, which is where the board fits in.

"Various programmes and schemes that have been developed by different government departments for the betterment of women, including sex workers, were ineffective because they were developed using a top-down approach which did not involve the community," Jana said.

"Our self-regulatory board has rescued both women and minors. We have rescued even 30 elderly women who have told the board that they have been trafficked," a member of the Kolkata-based NGO, said.

6 of our Usha agents were working on the sly for Saradha and collecting deposits for the company. Usha Cooperative Society, registered in 1995 is the first sex workers' cooperative in Asia run by Durbar to fight sex workers' economic exclusion from government and other financial institutions. The money collection racket for chitfunds started with the help of some influential pimps and strongmen. "We had no option but to do what they said. If we don't listen to them, they will disturb our business," said Priyanka (name changed), a sex worker at Sonagachi.

The chitfund fraudsters did not even spare sex workers in West Bengal. Trapped by the cheats to invest their hard-earned savings in ponzi schemes [Schneeballsystem], thousands of sex workers in the state's red-light districts have lost crores of rupees.

A majority of investments were made in the Saradha Group, which is under the scanner for defrauding lakhs of investors.

According to a survey conducted by an NGO, as many as 16,000 sex workers in 59 red-light pockets had invested more than Rs9 crore with various chitfund companies.

Though it is difficult to give the exact figure, the chitfund company agents had amassed more than Rs9 crore over the past three years from about 16,000 sex workers," said Bharati Dey, secretary of Durbar Mahila Samanwaya Committee.

Durbar is an exclusive forum of 65000-odd female, male and transgender sex workers in the state. Dey said in Sonagachi alone, about 3,000 sex workers invested more than `Rs.5 crore in Saradha's savings and deposit schemes.

"We noticed a sudden drop in our daily collective schemes since 2009-10. The sex workers had started depositing their money with chitfund companies like Saradha Group, Rose Valley and Sahara's schemes, expecting a sky-high return," Dey said.

According to sources, the sex workers used to deposit their savings with the Usha Cooperative Society, but the contributions significantly declined over the past three years.

Registered in 1995, Usha is the first sex workers' cooperative in Asia run by Durbar to fight sex workers' economic exclusion from government and other financial institutions.

When the representatives of Usha looked into the matter, they found that the chitfund companies were collecting daily savings deposits from the sex workers.

And it was some of the Usha agents only who had helped them sneak in. "We came to know that six of our Usha agents were working on the sly for Saradha and collecting deposits for the company. We expelled them and logged an FIR against some of them," said Dey.

The money collection racket for chitfunds started with the help of some influential pimps and strongmen.

"We had no option but to do what they said. If we don't listen to them, they will disturb our business," said Priyanka (name changed), a sex worker at Sonagachi.

Auf unseren Brief zu der unsäglichen ARD-Doku gibt es leider immer noch keine Antwort von Durbar. Aber angesichts solcher massiven Probleme und der großen Herausforderung auf nationaler Indischer Ebene die Self-Regulatory Boards (SRB) und Welfare Commitees einzurichten auch wiederum verständlich, dass wir Sexworker und Aktivisten aus dem fernen Deutschland nicht höchste Antwort-Priorität bekommen.

Supreme Court of India upholds the Bombay High Court verdict squashing the Maharashtra Governments decision to ban dance bars in Maharashtra.

Dance bars which were closed from August 15, 2005 by an amendment introduced in the Mumbai Police Act will now be allowed to reopen.

Defiant RR Patil, state home minister, said the government will take legal measures to ensure that the bars don’t restart.

Patil became popular among the middle class after the 2006 decision on the ban.

Women organisations had also called for the over 1,200 such bars in Maharashtra to be banned.

From 2009 through 2011, 2195 women and girls were screened by SRBs: 170 (7.7%) minors and 45 (2.1%) unwilling adult women were assisted and followed up. The remaining 90.2% received counselling, health care and the option to join savings schemes and other community programmes designed to reduce sex worker vulnerability.
Between 1992 and 2011 the proportion of minors in sex work in Sonagachi declined from 25 to 2%.

Conclusions
With its universal surveillance of sex workers entering the profession, attention to rapid and confidential intervention and case management, and primary prevention of trafficking—including microcredit and educational programmes for children of sex workers—the SRB approach stands as a new model of success in anti-trafficking work.

Mamata's government to re-house hundreds of former sex workers living on the Kolkata streets in their old age

Mamata Banerjee-led West Bengal government has decided to rehabilitate sex workers in a home.

A survey, led by Trinamool MLA and Kolkata Municipal Corporation's mayoral council member Shashi Panja, identified as many as 789 elderly sex workers who are so infirm that they cannot even go door-to-door for begging.

The government has identified an old two-storey building near the Tollygunj area where the rehabilitation centre for the aging sex workers and a residential school for sex workers' children will be housed.

Named 'Muktir Alo' (Light of freedom), the new address will accommodate at least 100 sex workers in the first phase.

The first hundred inmates will be decided through a lottery. While the housing department will renovate the building, the finance department will sanction Rs 50 crore annually [= 500 Millionen INR = 5,6 Millionen Euro pro Jahr = 56.000 Euro pro Wohnplatz und Jahr !!!] for the project, government sources said.

"It was a brainchild of our chief minister after she came to know about retired sex workers. She asked me to conduct a survey focusing on the condition of retired and ill sex workers.

"I submitted the report and accordingly a house has been identified for the purpose of accommodating at least 100 sex workers who have retired from the trade," Panja told Mail Today.

"There will be a residential school for sex workers' children as well in the two-storey building," she said, adding that the government will increase the number of rehabilitation homes in the future.

Sonagachi is home to over 10,000 sex workers, many of whom are trafficked from neighbouring Bangladesh and Nepal.

According to the locals, the area came to be known as Sonagachi after Sufi saint Sona Ghazi whose mazaar (tomb) is located in the northern part of Kolkata.

The buildings in this area house 6,000 brothel-based sex workers while those from the 4,000-odd 'flying' segment return home after their daily trade.

Initiative

"It is a very noble initiative by the state government. So far they (aged sex workers) have not received any such help from the administration.

"It is good that the administration thought of something positive for them also," Bharati Dey of Durbar, a voluntary organisation working for the welfare of sex workers, said.

Wir müssen SRB und Sexwork Akademie und OHS in unsere lautstark öffentlich immer wieder vorgetragenen politischen Forderungskataloge mit aufnehmen !!!

als ich den Artikel las, wurde mich fast schlecht!
Ich weiss nun, warum ich instinktiv noch nie nach Indien wollte:

Ja, entsetzlich. Nur der Schlusssatz des Artikels stimmt eigentlich nicht. Indienerinnen leben ja nicht in einer Anarchie, sondern in einer typischen Patriarchie. Vergewaltigung ist ein typisches Herrschaftsdruckmittel. Anarchie im wahrsten Sinne des Wortes bedeutet ein Zustand ohne jegliche Herrschaft. Ein Fall der Anarchismus-Stigmatisierung, sozusagen, aber das ganz nebenbei.

Übrigens habe ich eine feministische Prostitutiongegnerin gekannt, die gleichzeitig voller Bewunderung für Indien war....

die Bemerkung über den Begriff "Anarchie" ist richtig und wichtig!
Das passende Wort in dem Artikel wäre "Anomie" gewesen.
An-Archie bedeutet, wie du schreibst, "Abwesenheit einer
pyramidalen Herrschaftsstruktur". Das, was 1989 mit den
zwei Deutschlands im Prinzip passierte, war "Anarchie" =
der freiwillige Zusammenschluss von Individuen und Gruppen
zu einem gemeinsamen Projekt.

Das Forum hier ist auch zutiefst anarchisch, da die Personen
im Forum auf freiwilliger Basis gleichberechtigt sich äußern
können, um ein gemeinsames Ziel zu erreichen.

Auf Grund des Wortinhaltes kann man auch feststellen,
dass es ein "Matri-Archat" nie gegeben hat. Es gibt keinen
einzigen historischen oder archäologischen Beleg dafür.
Es gab, und es gibt immer noch kleinere Kulturen, bei denen
Frauen die Politik der Gruppe bestimmen (Beispiel Naxi).
Aber dort werden Männer weder ausgebeutet noch unterdrückt.

Oft werden aus Unkenntnis über den Sinn von Fremdworten
die falschen Begriffe verwendet.
Das am meisten "vergewaltigte" Wort ist sicher "explodiert",
wenn es statt dessen, "exponential" heissen sollte.
Wir alle kennen das Wort "Bevölkerungsexplosion".
Das Problem damit ist, dort, wo die Bevölkerung "explodiert",
z.B. in Syrien, Sudan, Iraq, dort wird sie weniger, nicht mehr!

Eine mutterrechtliche Kultur ist eben auch kein "Matriarchat",
sondern ehen matrilinear und/oder matrifocal, wenn es schon
Fremdworte braucht.

Bei den hier gegebenen Ratschlägen, könnte man auch gleich
nach Saudi Arabien reisen: keine Haut zeigen, nur lange Ärmel
und Beine bedeckt, nur in männlicher Begleitung, am besten
in großen Gruppen, aber nicht in Frauengruppen, nicht nachts
unterwegs sein, .....usw. Und die Belehrung, dass Inder
Frauen als Menschen zweiter Klasse ansehen, die vergewaltigt
werden können.

Die Ratschläge sind eigentlich nicht spezifisch für Indien: Auch in westlichen Großstädten sollte man sich z.B. abends nicht verlaufen - in Slums ist es überall auf der Welt gefährlich. Dass das Thema "Vergewaltigungen in Indien" in der internationalen Berichterstattung so präsent ist, zeigt eigentlich umgekehrt, dass es sich die indischen Frauen nicht mehr gefallen lassen, als Menschen zweiter Klasse behandelt zu werden. Bei jedem besonders üblen Fall sind sie bereit, zu demonstrieren um Druck auf Polizei und Richter auszuüben, die Täter zu fassen und zu bestrafen, und um generell die Frauenrechte zu stärken.

Solche Fälle sind aber nicht typisch für Indien (dort aber wegen der großen Bevölkerungszahl entsprechend häufiger): Gerade wir SW sind auch in Europa übelsten Übergriffen ausgesetzt, von Gruppen-Vergewaltigungen durch Polizisten in Frankreich bis zu Folter in Istanbuler Polizeihaft. Leider sind die europäischen Frauen nicht so solidarisch mit uns SW, um wie in Indien gegen solche Vorkommnisse zu demonstrieren.
