Executive Summary & Recommendations

In May 2007, the Network of Sex Work Projects (NSWP) commissioned an
independent review of its governance and organizational structure with the
view to reorganizing into an incorporated non-government organization. The
review was conducted by an consultant who was not a member of the NSWP. A
new way of organizing has been proposed and, in putting forth this model,
it is recognized that it is not perfect and that there are many inherent
complexities. The NSWP appears clear in its desire to move forward and
therefore, recognizes that structuring formally will entail some
compromises. Accordingly, this report presents the NSWP with 19
recommendations for its consideration. The background to each
recommendation is discussed within the report.





1. It is recommended that NSWP formalize its governance, structure and operations.

2. It is recommended that the NSWP be constituted as a membership-based
organization
and accordingly, members must agree to and abide by the
NSWP's mission statement and core values.

3. It is recommended that the NSWP commence the process of identifying
potential candidates for President so that the implementation of the new
structure can move quickly once the Board is constituted.

4. At this stage, it is recommended that NSWP address the issue of sex
worker self-determination and representation based on the following
principles. The regions via regional networks will nominate their Board
representatives
and, in doing so, they will address the issue of sex
worker representation taking into consideration what makes the most sense
in their region. Sex workers themselves will determine whom they wish to
represent them. The first Executive Committee will ensure that at least
four positions (including the President and Vice President plus three
other members) be sex workers or former sex workers and of course, this
percentage may be increased (if appropriate) over time.

5. As a minimum package, it recommended that the NSWP consider the
following full-time positions as its core staff:

Coordinator

Administrator/Finance officer

Communications Advisor

6. It is recommended that the Coordinator position be ear-marked as a sex
work or former sex worker-dedicated position
.

7. It is recommended that the Executive Committee be tasked with
addressing the mission statement as part of broader strategic planning and
it should provide the Board with guidance to ratify both the new mission
statement and strategic plan simultaneous. This task should be completed
within the first year of operation.

8. It is recommended that the NSWP develop a written Code of Practice to
guide the operations of its Board, members and staff and membership of the
NSWP is contingent on agreeing to abide by the Code.

9. It is recommended that the NSWP incorporate in the northern hemisphere.

10. It is recommended that the NSWP retain its name.

11. Once NSWP reaches agreement on the structure, it is recommended that a
constitution be drafted and endorsed immediately.

12. It is recommended that the NSWP develop a Policies and Procedures
Manual to guide the organization in its day-to-day operations.

13. It is recommended that once constituted, (and within the first 12
months) the NSWP should put in place a three to five-year Strategic plan
with annual operational plans.

14. It is recommended that the NSWP include a commitment to capacity
building
as a central component of its strategic plan and seek funding and
other opportunities to grow and mentor the next generation of sex worker
leaders and advocates.

15. It is recommended that, in addition to maintaining the web page and
listserv, the NSWP establish an intranet (password locked for members and
staff list only) and that this be used for posting in-house information.

16. It is recommended that the NSWP (subject to funding) explore the use
and capacity of emerging communication technologies as a way of expanding
information access, as well as building capacity in their use.

17. It recommended that, linked to the development of the Strategic Plan
and its implementation, the Board and Executive Committee undertake to
conduct an annual review of their functioning and the operations of the
organization (matched against pre-determined benchmarks). This score card
should be made available to the membership.

18. It is recommended that the NSWP move quickly to ratify these
recommendations and put in place an action plan to implement them.

19. It is recommended that the acting Coordinator remain in place until
funding is secured and a permanent Coordinator is appointed.

20. It is recommended that the NSWP constitute a volunteer co-ordination
committee to oversee the introduction of the report recommendations and to
address the myriad of logistical issues. This committee would remain in
place until the first board is constituted and they would work
hand-in-glove with the volunteer coordinator.

Die Zukunft des int. Netzwerkes der SW Projekte

Moving the NSWP forward



First apologies for the long silence – it has taken much longer
than expected to work our way through the legal minefields of the
Netherlands and United Kingdom.

The NSWP is moving forward in line with the recommendations in the
consultant's report and those agreed earlier this year; those
members on the current NSWP listserv who do not agree will need to
consider whether their organisation wishes to formally join the
newly incorporated NSWP as it moves forward. The current NSWP-list
listserv will be maintained to allow individuals to continue
sharing information until the elected Board of Directors have
completed the strategic operational plan in consultation with members.

The NSWP has registered in the United Kingdom as of 2 October 2008.

Registering in the Netherlands was rejected by the Coordinating
Committee, as a Dutch foundation would not have provided the level
of accountability required within the membership based organisation
that the NSWP is seeking to establish and develop. The NSWP's
Memorandum and Articles of Association (registration documents)
will be posted shortly on the NSWP website.

Until the elections for the President and the ten regional
representatives on the Board of Directors can be organised an
Interim Board has been formed from the members of the NSWP
Coordinating Committee who have overseen this process to date.

NSWP's Future:

1. Organisations wishing to become a member of the newly
incorporated NSWP and have voting powers will need to apply for
membership. Membership of the NSWP will be organised within
existing and emerging networks of organisations on a regional basis.

2. The governance and operational management of the NSWP will
be through
o a Board of Directors, including 11 Directors and up to 4 co-opted
advisers - the President elected by member organisations through a
global listserv, 10 regional members determined by and nominated
from regional networks/organisation [2 per region], and 4 non-
voting members 3 co-opted places, to ensure appropriate
representation and expertise, and the Coordinator when we recruit
staff; and an Executive Committee of 8 members, elected by and from within the Board.

3. No Director will be paid for services or work undertaken on
behalf of the NSWP, only out of pocket expenses will be reimbursed.

4. Key positions within the NSWP Board and Executive Committee
will be reserved for sex workers (current or former) to ensure
representation and sex worker leadership. However, sex workers in
each of the regional networks/organisations will determine how and
by whom they wish to be represented within the NSWP Board. Allies
will have a legitimate and welcome role when nominated by sex workers.

5. Members' participation and decision making will be
conducted primarily using Information Technology and electronic
voting, there is no requirement to have an Annual General Meeting
as long as the Annual Accounts and Directors Reports are circulated
and accepted by the members through resolutions, which can be done
electronically.

6. English will be the language of communication within the
Board of Directors, the Executive Committee and the global NSWP
members' listserv and website until such time as there is funding
or dedicated volunteers who are prepared to take on the task.
Meanwhile translation will be the responsibility of regional/
national networks and organisations

7. The NSWP will seek funding to establish a secretariat in
the UK, providing a central base for a core staff of 3 - a
Coordinator, a Finance/Administration Officer, and a Communication
Officer.

8. The Board of Directors and the Executive Committee will be
responsible for developing the NSWP as an advocacy and policy
organisation to target intergovernmental and national policy
makers, donors, researchers, etc.

Once the new Board (and hopefully staff) are in place, NSWP members
will be called upon to participate in assisting the Board,
Executive Committee and staff to develop and implement a Code of
Conduct for Members, the NSWP Mission Statement and Strategic
Operational Plan and a Policies and Procedures Manual for Board and
staff. The NSWP mission statement and strategic plan will be
developed in full consultation with members – so there will still
be plenty of opportunity to shape the future of the NSWP.


NSWP membership is open to sex worker organisations and sex work
project who include both sex workers and allies who support the
aims of the NSWP and agree with the membership criteria specified
in the registration document, which states the principles and
values that organisations must agree to in order to become members.

Principles and Values:
  • Acceptance of sex work as work
  • Opposition of criminalisation of sex work
  • Supporting self-organising and self-determination of sex workers


Membership of the NSWP will remain organisational, with an
individual who has been mandated by their group to sign a
membership application and vote on behalf of their organisation.
The UK allows informal groups to join as organisational members and
the process for this has been set out in the registration
documents, it requires an individual to be nominated to represent
the group and sign a membership application (section 3.5 of the
Articles of Association).

A membership application form will be sent to all organisations/
groups who are currently signed up on any of the NSWP listservs1
and will be advertised on the NSWP website. A new listserv will be
created for global NSWP membership business, including elections
for President and regional nominations for the Board of Directors.

Regional membership and elections - members will be asked on their
membership application form to identify the geographic region that
they wish to be affiliated to, as NSWP membership and elections to
the Board of Directors will be organised using existing and
emerging regional/national networks of organisations in Africa,
Asia/Pacific, Europe, Latin America, and North America. Each region
will determine its own structure and mechanisms for electing 2
representatives to the NSWP Board of Directors - it is not for the
NSWP as a global network to tell regions how to organise themselves
or who they can nominate to the Board of Directors.

Each region will organise elections of two representatives to be
nominated to the Board of Directors - in the first election one
Director will be elected for one year and the second Director will
be elected for two years, thereafter Directors will be elected for
a two year term to ensure continuity in the Board of Directors.
Once the two representatives have been elected by the region they
are then nominated to Board of Directors by resolution. Directors
may be re-nominated to the Board of Directors for up to 4
consecutive terms (up to 8 Years).



NSWP's Funding:

OSI-SHARP provided $20,000 (US) funding in January 2008 to enable
the NSWP to register as a legal entity and set up financial
management systems, to organise the election of the President and
Board of Directors, to maintain the NSWP website and listservs and
to seek funding for the secretariat and core staff. The project has
been extended to the end of December 2008. SCOT-PEP (an
organisation set up by and for sex workers, based in Edinburgh,
Scotland) will manage this grant - the funds provided by OSI will
be held and managed separately from SCOT-PEP's funds and financial
statements will be prepared for both OSI and the NSWP. Part of this
funding is to recruit a consultant to prepare a funding strategy
and write funding applications for the NSWP - please forward names
and contact details of anyone you would recommend for this
consultancy.


HIVOS provided €37,000 funding (over 2 years - 2008 & 2009) to
enable the NSWP to produce two editions of Research for Sex Work www.researchforsexwork.org -
SCOT-PEP will manage this grant until such time as the NSWP is
registered and has its own bank account.

An additional application for $30,000 Core funding per year for two
years is being submitted to OSI-SHARP for 2009 & 2010. We should
hear if it has been successful later this year.

The NSWP is now incorporated in the United Kingdom - Company No: SC349355 and its registration documents are now available on the NSWP website.

Registered Office:
NSWP, c/o SCOT-PEP, 70 Newhaven Road, Edinburgh EH6 5QG, Scotland UK. The registered office can be easily changed once the Secretariat is established.





We are now inviting organisations to apply for NSWP membership.


NSWP membership is open to sex workers' organisations and sex work projects that include both sex workers and allies who support the aims of the NSWP and agree with the membership criteria specified in the registration document, which states the principles and values that organisations must agree to in order to become members. These are:

o Acceptance of sex work as work

The form is in UK legal speak – by signing and returning them to the NSWP you are agreeing to become a formal member of the NSWP, have you r organisation's name as a matter of public record in the United Kingdom, and if the NSWP closes to pay up to £1 towards any debt the organisation may have at that time.

NSWP membership will entitle your organisation to vote in the global election of the NSWP President and to participate in the regional election processes currently being established for the Board of Directors (2 places per region).



A global members' listserv has been established to facilitate communication directly with members and a membership page is being set up on the NSWP website.





Regional membership and elections

Funding

I received confirmation today that our core funding application to OSI-SHARP was successful – we will have $30,000 for 2009 and a further $30,000 for 2010, which will support the development and updating of the NSWP website, financial and legal administration overheads in the UK and enable a meeting of the elected Board of Directors.

Global Denken - Lokal Handeln

Hier ist das möglich:



Zur kommenden 40. Fachtagung Prostitution / 65. Sexworker Kongress versuchen wir die Vernetzung unter uns lokal zu verbessern.

NSWP ist der zugehörige Welt-Sexworker-Verband, der Aktivisten international unterstützt mit Informationen, notwendiger Öffentlichkeit und Wahrnehmung durch transnationale Gremien.





Was bringt eine Mitgliedschaft bei NSWP?:
  • Mitgliedschaft bedeutet verbesserten Zugang zu Informationen über Prostitution aus der ganzen Welt
  • Lobbyarbeit, um prostitutionsfeindliche Dokumente (wie z.B. bei Unaids oder anderen Organen) zu verhindern bzw. zu veraendern
  • Mit einem internationalen Netzwerk können sich Sexworker besser Gehoer verschaffen
  • Internationale politische und solidarische Unterstuetzung bei Kampagnen, Aktionen etc. kann die Positionen von Prostituiertenorganisationen vor Ort verstaerken.
  • Durch eine Mitgliedschaft können die politische Arbeit und Kampagnen mitbestimmt werden.



Was wurde bisher erreicht?:

Der bisher groesste Erfolg der letzten Zeit war, dass NSWP die erste Version der Unaids Guidance Note about HIV/AIDS and Sex Work (2007), die sher abolitionistisch ist, durch Lobbyarbeit verhindert haben und sie ueberarbeitet werden musste.

Die neue Version von Februar 2009 soll jetzt implementiert werden, obwohl sie noch immer diese abolitionistischen Zuege hat, wenn auch schoen verpackt in einem Menschenrechtsdiskurs.

NSWP Forderung ist, dass die Umsetzung vor Ort nur im Dialog mit Prostitutionsorganisationen passieren darf, um Schaden zu verhindern.





Pläne für die Zukunft:

Fuer die Zukunft ist das Ziel in jeder Region eine gute Kommunikation und Austausch zwischen den Sex Worker Rights Activist Groups zu haben, um wirkungsvoller handeln zu koennen. Auch wird die Website neu strukturiert, um interaktiver zu werden.





Hier folgen demnächst die ins Deutsche übersetzen Beitrittsformulare. Englische Version gibt es bereits (s.o.).

The Global Network of Sex Work Projects (NSWP) is marking the 7th annual International Day to End Violence Against Sex Workers with the release of the “Sex Work and Violence” issue of the NSWP journal Research for Sex Work and the launch of a brand new NSWP website:

Both the journal and the website amplify the voices of sex worker-led organisations around the world that speak out about violence from police, institutions, clients, and intimate partners, while challenging the myth that sex work is inherently violence against women.

The criminalisation of sex work increases the vulnerability of sex workers to human rights violations and violence. However, sex workers are raising awareness, working with policy makers, and organizing against this violence, as the following examples from Research for Sex Work show:
  • In Central Eastern Europe and Central Asia, a survey of 238 male, female, and transgender sex workers conducted by the Sex Workers’ Rights Advocacy Network (SWAN) found that 42% of sex workers in the region reported having experienced physical violence by the police and 36% had experienced sexual violence.
  • Since 2006, police in Liverpool, UK have agreed a policy in which all crimes against sex workers are treated as hate crimes and have appointed a sex work liaison officer.
  • Though recently institutional violence in Cambodia has gotten a lot of attention, violence committed against sex workers by intimate partners is also a major problem. The Cambodian Prostitute Union provides education to sex workers and their abusive partners about the domestic violence law as well as counseling, support, and service referrals for sex workers.
  • The Aboriginal Sex Workers Education and Outreach Project in Canada was founded in 2008 to focus on the needs of Aboriginal street-based sex workers, who experience high rates of violence and HIV infection. Indigenous women are infected with HIV at nearly twice the rate as women in the general population.
NSWP’s members include 118 organizations and groups from 40 countries that work to promote the health and human rights of sex workers.
